Review the conditions for using ADVISOR responsibly
Please review these terms carefully. They reflect the decision-support nature of the platform and reinforce that users remain responsible for professional review and real-world decisions.
1. Nature of the Service – Decision Support Only
ADVISOR by Threatwise™ is an AI-assisted decision-support tool designed to support Behavioral Threat Assessment and Management (BTAM) triage and documentation.
The Service is not a diagnostic tool, is not a risk prediction system, does not provide legal, medical, financial, clinical, or professional advice, and does not replace trained professionals or multidisciplinary teams.
Outputs are generated based solely on user-provided information and automated AI processing. Threatwise does not independently verify user inputs or Outputs.
You are solely responsible for reviewing, verifying, editing, and independently validating all Outputs before relying on them in real-world decision-making.
Threatwise makes no representation or warranty that Outputs are accurate, complete, reliable, or appropriate for your specific circumstances.
Threatwise has no obligation to monitor, supervise, validate, or intervene in any user activity, case, or real-world situation. The Service does not provide active monitoring, emergency response, or real-time threat intervention.
2. User Responsibility and Professional Review
You acknowledge and agree that you are solely responsible for all decisions, actions, and outcomes resulting from your use of the Service.
You will not rely exclusively on AI-generated Outputs when making safety, employment, disciplinary, legal, medical, or other consequential decisions, and you will consult qualified professionals when appropriate.
Reliance on the Service is at your own risk. You expressly assume full responsibility for any real-world consequences arising from your use of or reliance upon the Service.
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials, all activities conducted under your account, notifying us promptly of unauthorized access, and providing accurate and complete information.
We reserve the right to suspend or terminate accounts for inaccurate information, misuse, or violations of these Terms.
4. Acceptable Use
Excessive usage, abuse of AI processing resources, or conduct that risks upstream provider suspension may result in immediate account suspension or termination.
- Violate any applicable law or regulation
- Input highly sensitive regulated data, including medical records, financial account numbers, classified information, or restricted government data
- Use the Service to harass, threaten, discriminate, defame, or harm others
- Use Outputs as the sole basis for employment termination, disciplinary action, or emergency response decisions without independent review
- Represent Outputs as professional advice issued by Threatwise
- Attempt to reverse engineer, probe, exploit, or test system vulnerabilities
- Interfere with Service infrastructure
- Use automated scraping, bots, or abusive automation
- Bypass subscription limits or technical safeguards
5. AI Processing and Usage Limits
The Service relies on third-party AI infrastructure providers. You agree to comply with all applicable third-party terms governing such infrastructure.
We reserve the right to monitor usage patterns for abuse prevention and system integrity. Excessive or abusive use may result in rate limiting, temporary suspension, or immediate termination without refund.
6. User Content and Outputs
You retain ownership of content you input into the Service. By submitting User Content, you grant Threatwise a non-exclusive, royalty-free license to process and use such content solely as necessary to provide and support the Service.
Outputs generated by the Service are provided for your internal use. As between you and Threatwise, you own Outputs to the extent permitted by law, subject to our ownership of the underlying platform, models, and intellectual property.
We do not use User Content to train proprietary AI models owned by Threatwise. AI processing is conducted via third-party infrastructure providers subject to their data handling policies.
You are solely responsible for the legality of User Content, having authority to submit such content, and evaluating and validating Outputs.
7. Privacy
Your use of the Service is governed by our Privacy Policy, incorporated herein by reference. By using the Service, you consent to data processing practices described therein, including processing by authorized subprocessors such as Auth0, Stripe, Pinecone, Google, and AI infrastructure providers.
The Service is not intended as a secure repository for regulated or highly sensitive data. We may update subprocessors in the ordinary course of business.
8. Intellectual Property
All software, content, branding, and features of the Service are owned by Threatwise Global LLC and protected by applicable intellectual property laws.
ADVISOR by Threatwise™ is a trademark of Threatwise Global LLC. Unauthorized use is prohibited.
9. Payments and Subscriptions
The Service may be offered on a subscription or usage basis. Payments are processed via Stripe. By subscribing, you authorize recurring charges unless canceled pursuant to our cancellation policy.
All fees are non-refundable except as required by law. You agree not to initiate chargebacks or payment disputes without first contacting us for resolution. Fraudulent chargebacks may result in termination. Late payments may accrue interest at 1.5% per month, or the maximum permitted by law.
10. Disclaimer of Warranties
The Service is provided as is and as available. To the maximum extent permitted by law, Threatwise disclaims all warranties, express or implied, including accuracy, fitness for a particular purpose, reliability, availability, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that Outputs will prevent harm, mitigate risk, or achieve any particular outcome.
11. Limitation of Liability
To the maximum extent permitted by law, Threatwise shall not be liable for indirect, incidental, consequential, special, or punitive damages; loss of profits, revenue, data, or goodwill; claims arising from reliance on Outputs; or claims related to workplace, employment, safety, disciplinary, or threat management decisions.
Our total aggregate liability shall not exceed the amount paid by you to Threatwise in the preceding twelve months. These limitations apply regardless of the theory of liability.
12. Indemnification
You agree to indemnify, defend, and hold harmless Threatwise Global LLC and its affiliates from claims, damages, liabilities, or expenses arising from your use or misuse of the Service, your violation of these Terms, your reliance on Outputs, or User Content you submit. These obligations survive termination.
13. Termination
We may suspend or terminate access at any time for violation of these Terms, non-payment, or conduct that threatens system integrity or upstream provider compliance. Upon termination, we may delete account data consistent with our data retention policies.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Minnesota. Any dispute shall be resolved through binding arbitration administered by the American Arbitration Association in Minneapolis, Minnesota, under its Commercial Arbitration Rules.
You waive any right to a jury trial or to participate in a class action. Either party may seek injunctive relief in court for intellectual property or misuse claims.
15. International Users and Export Controls
The Service is controlled from the United States. You represent that you are not located in a sanctioned country and are not on a U.S. government denied party list. You agree to comply with applicable export laws.
16. Force Majeure
Threatwise shall not be liable for delays or failure to perform due to events beyond reasonable control, including natural disasters, cyberattacks, service outages, labor disputes, or governmental actions.
17. Miscellaneous
If any provision is held invalid, the remainder remains in effect. These Terms constitute the entire agreement between you and Threatwise. We may assign these Terms. You may not assign without prior written consent. No waiver of breach constitutes waiver of future breach.
